1. understand key legislation and agreed ways of working that support the fulfilment of rights and choices of individuals with dementia whilst min. The risk of harm:

Key legislations - UDHR 1948
-Common law Rights
- Human Rights Act 1998
-Mental Capacity Act 2005
-Adults with incapacity (SC) Act 2005
- Mental Health Act 2007
- The Disability Discrimination Act 1995
- Safeguarding vulnerable Groups Act 2006
-Carer ( Equal opportunity) Act 2004

All above legislation have been put in place After serious consequences of bad behaviour/ abuse/ health problems ( carers) in order to learn from them, prevent them and prosecute them as well as protect all involved. ( Clients in care and caring carers)

hat relates to fulfilment of rights and choices and the minimising the risk of harm for an indiv. With dementia:

All above legislation have been put in place After serious consequences of bad behaviour/ abuse/ health problems ( carers) in order to learn from them, prevent them and prosecute them as well as protect all involved. ( Clients in care and caring carers)

Example: helping client of the bed. If drag lifted it can injure a client and carer can be prosecuted as well as carer can injure himself or be injured by client in pain. There for in order to protect all involve, other methods ( just assisted final push or other) should be use.

If client insists on drag lift, carer can decline the offer in order to protect his health. If Carer does it against client's will or with client in pain, carer can be prosecuted or hold liable.

1.2 Evaluate agreed ways of working that relate to rights and choices of an individual with dementia:

After long perion of obuse done by carer to clients on one side and damaged health done by clients ( inantetionally) to carers on the other side, finalty lots of have been done.

Realising importantce and dangers of/ for both various changes in laws, new procedures, control bodies (cqc) and other have been made.

All new and agreed ways of work and other are here to protect all involved in care ( clients, Carers, professionals, family). And comming from bad past in order to improve future and avoid the same mistakes.

However, there has always been very fine line ( still is) between promoting rights and choices and keeping all involved safe and in good health. Every situation is different from one individual to another. It is there for constadly involving process.

Have to add, that in most cases all rights and choices at places I have been are fully preserved, respected and promoted in order to benefit the clients as well as in order to keep staff safe. ( keep healthy).

As for to evaluate, we can conclude/ say that promotion rights, freedoms of clients as well as setting up new internal( company/ organisation policies) or external ( law passed by local/ national goverment) rules. Regulations are needed. It is and will be constant movement which cannot and must not be stopped. As new medication as well as mentality of people is contadnly developing/ changes so should everything around them in order to benefit and protect all ( clients, their families and carers).

Recent shake- up in various Acts( Health & Safety equality Act, Safeguarding and other) have proven to us how important is to keep this movinng " maschine" going. After all, these recent shakes- ups were just result of the fact that the previous ones done in 80's were not enough any more.
